Morning Bell: What The Baucus Bill Will Cost You

This morning the Senate Finance Committee will resume their markup of Chairman Max Baucus (D-MT) health care bill. Thanks to Sens. Chuck Schumer (D-NY) and Jay Rockefeller (D-WV) the focus today will be on whether or not the Democrats on the committee can find enough votes to include a government-run insurance program. Just like Speaker Nancy Pelosi’s (D-CA) preferred public plan, Rockefeller’s plan would set price controls for health reimbursements at 5% above Medicare reimbursement rates. If the public plan was opened to all individuals and families, 103.4 million Americans would end up on the public plan, 88.1 million of whom would first lose their existing private coverage.

It is unclear at this point if centrist Democrats in Congress are really ready to force this many people out of their existing private care and into government-run health care. But even if the public option is not included, there are still plenty of regressive job killing taxes and invasions of privacy in the Baucus plan that makes it terrible public policy:

Taxes Families - Under the plan,  everyone will have to have health insurance by 2013. The mandate will apply to all adults and their dependents under age 18. Those who failed to buy insurance would be forced to pay an annual tax between $750 and $3,800 per year. Those who fail to pay the tax could be jailed for up to one year. Worse, 7.7 million households would face a 35% excise tax on their health insurance. 94% of these households would be paying a higher tax rate on their health insurance than they would be paying on their income.

Taxes Businesses - Employers with more than 50 employees that don’t offer health coverage would have to pay a penalty for each employee who qualifies for new federal subsidizes under the bill. To stay in business employers will be forced to cut jobs and cut wages.

Taxes the Sick - The Baucus bill imposes higher taxes on manufacturers and importers of medical devices, health insurance companies, clinical laboratories, manufacturers and importers of drugs. In effect, the Baucus proposal would tax the sick to subsidize insurance for the healthy, and many of the taxes would be imposed on the same people “helped” by the subsidies.

Invades Your Privacy - The Baucus bill enforces both its individual and employer mandates by deputizing the Internal Revenue Service. To enforce these provisions, the bill would therefore require individuals, health insurers, employers, and government health agencies to report detailed health insurance information on all Americans to the IRS, adding significant administrative costs and reducing privacy protections. The IRS would also be required to report personal income data to state exchanges, insurance companies, and employers because premium credits and out-of-pocket limits would depend on income.

ELDERLY MOVING AGAINST OBAMACARE

America’s elderly are finally realizing that Obama’s health care changes are largely financed by cuts in Medicare and are rallying against his proposals in increasing numbers.

The latest poll by Scott Rasmussen not only shows national opposition to Obamacare rising — now it is 41-56 against — but also shows the elderly moving against it even more strongly by 33-59 or almost 2:1.

And well they should!  Three-quarters of Obamacare is to be financed by slashing $500 billion from Medicare over the next ten years.  That comes to an eight percent cut.  Next year’s total Medicare spending, for example, will be about $500 billion by itself, so this is like having one year without Medicare at all!  Obama’s fatuous claim that the cut will not affect care for the elderly is specious as any thinking person would realize.  We have gone through previous incarnations of those who wanted to slash Medicare and pretended that it would not affect the elderly.  Newt Gingrich tried to sell this act of alchemy in 1995 and the elderly didn’t buy it then and aren’t buying it now!

It is obviously impossible to cut Medicare reimbursement without slashing the time doctors spend with patients.  It is equally obvious that you cannot cover 30 million new patients without more doctors and nurses.  And the Medicare cuts in doctors’ fees will, of course, cause a decrease in the number of medical professionals.  Investor’s Business Daily conducted a poll in September which showed that 45% of all doctors said they would seriously consider retiring or closing their practices if the Obama bill passes.  A larger number will likely refuse to treat Medicare patients.  Indeed, current law provides for a 21% cut in Medicare fees to doctors next year and a 6% cut the year after.  The new $500 billion in cuts are on top of these reductions!   What kind of medical care do we expect our elderly to receive when the doctor who they visit is getting $35 or $40 for seeing them!

But the Senate appears ready to ram this bill through regardless of what the public or the elderly think.  They have 60 votes and they won’t listen to anyone.  But we have to make them listen!

PLEASE take two steps right now.

1.  I have persuaded the League of American Voters to run ten second advertisements in key states that show an elderly person saying:  “Senator _________: Please don’t cut my Medicare by $500 billion.  I need my Medicare.”  We need to get these ads on in the key states.

Obama would like us to believe that the key issue is whether or not to have a public option, precisely because he is prepared to concede the point (and have a co-op which would be run by the government for at least the first three years instead).  But we need to focus attention on the cuts in Medicare.  It is slashing services to the elderly that is the key point!

So please go to the link below and give very, very generously.  This is the key moment and you can make all the difference in the world.  With pressure such as the elderly are bringing to bear, the Senate would not dare pass this benighted plan!

Obama’s UN Speech, Dissected

In the UN speech earlier today, President Obama once again succumbed to what has become almost a clinical addiction: criticizing the United States in front of an international audience.

In the latest stop on his American Apology Tour, Obama aimed his fire at America on the issue of global warming (“the days when America dragged its feet on this issue are over”) and democracy (“in the past America has too often been selective in its promotion of democracy”). And Obama, after humbly declaring at the outset of his speech that “I am well aware of the expectations that accompany my presidency around the world . . . they are also rooted in hope—the hope that real change is possible, and the hope that America will be a leader in bringing about such change,” went on to say this:

I took office at a time when many around the world had come to view America with skepticism and distrust. Part of this was due to misperceptions and misinformation about my country. Part of this was due to opposition to specific policies, and a belief that on certain critical issues, America has acted unilaterally, without regard for the interests of others. This has fed an almost reflexive anti-Americanism, which too often has served as an excuse for our collective inaction.

Where oh where to begin? How about by pointing out that America did not act unilaterally in Iraq or anywhere else during the Bush presidency. For example, and for the record, more than 35 countries gave crucial support—from the use of naval and air bases to help with intelligence and logistics to the deployment of combat units. President Bush answered the “unilateral” charge in his 2004 State of the Union address:

Some critics have said our duties in Iraq must be internationalized. This particular criticism is hard to explain to our partners in Britain, Australia, Japan, South Korea, the Philippines, Thailand, Italy, Spain, Poland, Denmark, Hungary, Bulgaria, Ukraine, Romania, the Netherlands, Norway, El Salvador, and the 17 other countries that have committed troops to Iraq. As we debate at home, we must never ignore the vital contributions of our international partners, or dismiss their sacrifices.

Second, the United States actually did have in mind the interests of others—beginning with 25 million Iraqis—when it acted. The Iraq war, whatever you think about its wisdom and execution, was in part a war of liberation, undertaken for noble purposes: to liberate a captive people and to depose an aggressive dictator. We know about the Iraqi regime under Saddam Hussein; it was one of the most brutal and malevolent in modern history. The fact that we believed the Iraq war advanced America’s national interests doesn’t mean it was a war waged without regard for the interests of others. And for Obama to allow this misperception of America to go unchallenged—indeed, to give such a false and malicious charge legitimacy—is disturbing.

Third, in his speech the President said, “I pledge that America will always stand with those who stand up for their dignity and their rights.” Oh really? If so, then why was he so reluctant to speak out for the brave Iranians who rose up against the brutal rule of President Ahmadinejad? Because of his fear not to offend the Iranian regime, he essentially put America on its side rather than on the side of the Iranians who stood up for their dignity and rights. In addition, Obama and his secretary of state are purposefully downplaying human rights in their dealings with China—including refusing to meet with the Dalai Lama. It is no secret that Obama—in an effort to distance himself from his predecessor—has very few words, and none memorable, to say on behalf of basic human rights. He will from time to time mouth empty slogans so he can check off the “human-rights box,” but he does not give any evidence that he feels these values deep in his bones.

There is more to be said about the Obama speech—including the president’s tiresome pretense that he and he alone will lead the world out of its cul-de-sac, where “we bicker about outdated grievances.” But I cannot escape a depressing thought, one I hope is proved to be wrong over time: that Barack Obama, even though he is the leader of America, is constantly placing himself above it. His criticisms of our country are now part of a troubling routine, so much so that Obama is now winning the applause of people who genuinely hate America (like Fidel Castro, who complimented Obama for his “brave gesture” and “courage” in criticizing the United States at the UN).

Obama not only fails to strongly defend the United States; he is actually adding brush strokes to a portrait of our country that diminishes its achievements and standing. He seems unable or unwilling to speak out—in a heartfelt and passionate way—on its behalf. He is, of course, too clever not to ever say a word of praise for America; no, this sophisticated wordsmith and smooth politician, this cool customer ever in search of The Golden Mean, can speak in both text and subtext. He says just enough to deny the charge that he is not a strong defender of the country he leads. But by now we’re on to the game.

No one believes America’s history is pristine; we are all familiar with the catalogue of our own sins, beginning with slavery. Other presidents have recognized them, and a few have given voice to them. But it was done in the context of a reverence for America—for what it has been and stands for, for what it is and can be. Think of the words of George Washington, who said of America, “I was summoned by my Country, whose voice I can never hear but with veneration and love.” That is a noble sentiment from a man whose love of country knew no bounds. They are also words that I cannot imagine President Obama saying, at least with conviction. That doesn’t mean he doesn’t like his country or admire things about it; it means that he has yet to really speak out for it. And it means that he has shown, so far at least, that he is more interested in advancing his interests than in speaking on behalf of the nation that elected him. There are enough critics of America in the world; we don’t need to add America’s president to that list.

Perhaps Mr. Obama will come to understand that there is a problem when the president of the United States—an “inestimable jewel,” Lincoln called her—has harsher things to say about his own country than he does about many of the worst regimes on Earth.

It is all quite disturbing, and to have to say this about an American president almost makes me sick.

Every American needs to learn what “reconciliation” is and how NOT to use it

These are not the words of a Republican or a conservative activist.

This is a warning issued on April 2 of this year from the former Democratic Majority Leader in the Senate, Robert C. Byrd (D-W.Va.).

He was referring to a dangerous assault on American freedom as it is protected by the constitutional balance of power – an assault that is being considered by the Obama Administration right now.
“We Pour Legislation into the Senatorial Saucer to Cool It”
The Founding Fathers designed the Constitution and our government to guard against political power grabs by slowing down the process of making laws.

They insisted that the Senate had to be a deliberative body to slow down the passions of the House and stop mob rule from destroying freedom.

In a famous conversation between the two presidents, Thomas Jefferson is said to have asked George Washington why the Framers had agreed to a second chamber in Congress at the 1787 Constitutional Convention. “Why did you pour that coffee into your saucer?” Washington asked him. “To cool it,” said Jefferson. “Even so,” said Washington, “we pour legislation into the senatorial saucer to cool it.”
The Founders Relied on the Senate to Carefully
Consider Before They Commit Us to a New Law
One of the key means by which the Senate slows down the legislative process is through the filibuster.

Unlike in the House, in the Senate, even a small group of senators can hold up a bill by threatening to continuously debate it.

It takes the votes of three-fifths of the Senate, or 60 senators, to end a filibuster. This means that it effectively takes 60 votes to pass a controversial piece of legislation or nomination.

And again, this is for good reason. The Founders looked to the House to more directly reflect the will of the people. They relied on the Senate to take a step back and carefully consider a bill before they commit the American people and our resources to it.
A Revolutionary Act Worthy of a Third World Country
I have taken this brief tour of American constitutional history to make an important point: The Obama Administration clearly has concluded it cannot get a big government health plan through the Senate if they accept the traditional, historic requirement of a 60-vote majority.

It is also clear left-wing activists would cheerfully destroy the integrity of the Senate and the freedoms it protects if that is what it takes to get a government-run, bureaucratic health care system which would expand their power and increase the importance of Washington.

Senator Harry Reid (D-Nev.), the Democratic majority leader, has warned that a failure to get 60 votes would lead him to try to force through a bill with 50 senators and Vice President Joe Biden breaking the tie.

Changing one-sixth of the American economy with 50 senators voting yes would be a revolutionary act worthy of a third world country.
Senator Byrd: “Reconciliation was Intended to Adjust
Revenue and Spending Levels in Order to Reduce Deficits”
The Obama Administration and Sen. Reid are considering getting around the 60-vote majority rule in the Senate by using a process called “reconciliation.” Under reconciliation, just 51 votes are required to pass a bill.

Democratic Sen. Robert Byrd, whom I quoted at the beginning of this message, has unique authority on reconciliation. Not only is he the author of a remarkable history of the Senate (four volumes published between 1989 and 1995), he was, as he wrote, “one of the authors of the reconciliation process,” which was created in 1985.

Here is what he said about using reconciliation to pass things like health care reform: “I can tell you that the ironclad parliamentary procedures it authorizes were never intended for this purpose. Reconciliation was intended to adjust revenue and spending levels in order to reduce deficits.”

Sen. Byrd concluded with this warning: “The Senate cannot perform its constitutional role if senators forego debate and amendments. I urge senators to jealously guard their individual rights to represent their constituents on such critical matters.”
For 20 Years, I Was Told to Be Patient When
Conservatives Couldn\’t Muster 60 Votes
For 20 years as a member of the House, I was told to be patient when conservative reforms could not muster 60 votes or a conservative nomination could not get 60 votes.

For the last decade I was told to be patient when reforms conservatives wanted and personnel conservatives wanted were blocked by the lack of 60 votes in the Senate.

Now after a lifetime of sustaining the constitutional role of the Senate, we find that the left wants to suspend the normal constitutional process so they can ram through a gigantic government run health program immediately.
Every American Who Cherishes the Institutions That Have
Preserved Our Liberty Will Tell Their Senators to Fight
We are being told the Obama agenda is so important we should destroy the Senate and make it more like the House of Representatives.




This radical action may make sense to President Obama, Chief of Staff Rahm Emanuel and senior strategist David Axelrod, all of whom come from Chicago and are used to seeing the Chicago City Council muscled by a strong mayor on behalf of a machine.

However, every American who cherishes freedom and appreciates the institutions that have preserved us from tyranny will be telling their senators to preserve the integrity of the Senate and preserve the protections of American liberty.

This fight over process may turn out to be even more important than the fight over the substance of the big government, big bureaucracy, high-tax health bill they want.

When both process and policy are wrong there is something very bad going on.
